Sec. 46.04. UNLAWFUL POSSESSION OF FIREARM. (a) A person who has been convicted of a felony commits an offense if he possesses a firearm:
(1) after conviction and before the fifth anniversary of the person's release from confinement following conviction of the felony or the person's release from supervision under community supervision, parole, or mandatory supervision, whichever date is later; or
(2) after the period described by Subdivision (1), at any location other than the premises at which the person lives.Originally posted by bcoop View PostJust seems to me a person hired to enforce the law ought to know the laws they are enforcing. Apparently he does not. Which doesn't surprise me, given his track record of posts on here.

It really is a shame that a guy got killed over a few pot plants that are probably legal in other states.Originally posted by racrguyWhat's your beef with NPR, because their listeners are typically more informed than others?Originally posted by racrguyVoting is a constitutional right, overthrowing the government isn't.

EDIT: I was surprised to read the law, I was totally ignorant of that section. Learn something new every day.

What a fucking total waste. No knock warrants are fucking bullshit in 99.99% of cases unless there is a violent crime in progress. I'm really surprised we don't hear about this more often. All over a couple of fucking pot plants. I would be pretty upset if that was how my life ended. I hope the homeowner is exonerated. Murder my fucking ass.

I think the murder rap is BS, too. Did he intentionally kill someone? Debatable since in his mind it was a home invasion! I'm sure the lawyer is saying he was just trying to stop the threat. And since it was a LEO, insta-Capital charge!"Self-government won't work without self-discipline." - Paul Harvey

According to the Bryan-College Station Eagle, Sowders had obtained a search warrant for the residence after obtaining information that the homeowner was growing marijuana and possibly had stolen guns. The warrant was a "no-knock" warrant, meaning police could forcibly enter the residence without giving residents a chance to respond.
Sounds like they had a solid plan...
