The law is a complicated and always changing book. It is not surprising that a beat cop doesn't know, by heart, every statute and code.

Sec. 46.04. UNLAWFUL POSSESSION OF FIREARM. (a) A person who has been convicted of a felony commits an offense if he possesses a firearm:

        (1) after conviction and before the fifth anniversary of the person's release from confinement following conviction of the felony or the person's release from supervision under community supervision, parole, or mandatory supervision, whichever date is later; or

        (2) after the period described by Subdivision (1), at any location other than the premises at which the person lives.
I believe federal law and state law differ on this subject.

Oh and fuck no knock warrants. I am a big fan of taking them down outside the residence and then executing your search warrant.

They do. Doesn't state override Federal in such an instance? State's rights and all.

That's easy. If you aren't a federal agent, you don't go around enforcing federal law, provided you aren't actively assisting a federal agent.

State law overrides federal law in this case.

EDIT: I was surprised to read the law, I was totally ignorant of that section. Learn something new every day.

Unless we're discussing one of the enumerated powers of the federal government, the 10th amendment states that the States have supremacy as outside of those enumerated powers and amendments, the federal has no authority to speak on matters.

Exactly what I said earlier! I have no idea why this option isn't used more frequently than a no knock warrant other than it's not as glamorous and maybe the department is trying to justify the cost of training and equipment.

I don't understand.... So if there was pounding at the door, which I would guess is knocking, how is it a no knock? I am guessing the pounding was trying to bust open the door then?
