1. The guy was drunk and several witnesses mention this....where is the non-lethal force (Tazer, Pepper spray/foam, mace, baton to the knees)? The officer, as trained as they are should be able to spot a drunken person and respond accordingly. I would hope that someone who is authorized to walk around with a weapon that is secured by a small leather strap would be capable enough to hold onto it...responsible gun ownership applies to us; it should apply to them as well.
2. How the hell does a sober officer become overpowered by a drunk to the point he fears for his life? Maybe he should be sitting behind a desk where he is more competent and not restrained by their lack of physical capabilities. Hell, at this point, all you would need is a whole department of fatties walking around in order to start having justified shootings all the time as they were incompetent enough to respond with the same measure of force that is exerted upon them and feared for their life.
Departments should maintain a physical requirement on a bi-annual/quarterly assessment. To me, I would only want capable officers protecting my community, not some fatty or 65 year old officer, to me, that is the same as giving a gun to someone who cannot handle it.
3. The officer does have a small bit of responsibility as to what happened as he made a mistake as well by being unfamiliar or unaware of his exact location, physically incapable of restraining the suspect and procrastinated too long before attempting to restrain the suspect; 60 commands...how long did that take? It’s no wonder the guy didn’t take him seriously and even then, the officer should have recognized the threat of “hey, this guy is not doing as he is told”. If I allow someone access to one of my firearms, intentional or not, and they use it in a criminal way, you can be damned sure someone will be looking at me. If I allow someone access to a metal pipe and they go and beat someone to death with it…you can bet someone will be asking “where did the pipe come from”.

I have no problem questioning the man with the gun but not while it is pointed at me. Questioning and getting physical are also two completely different things that also bring different responses. Call me crazy but when I hear "i am going to shoot" I won't be responding with sarcasm and a charge!

Being an honor student really is irrelevant to the situation. So if he was not an honor student does it change the situation? Because everyone says "he was the most gentle human they had ever known" make any difference when he is beating the cop with his night stick? Not a bit! Could any of this have been prevented? Absolutely and everything should be looked at to prevent it from happening again. He was not some innocent victim that got put into a bad situation unwillingly. Every step of the way he made a decision to escalate and it started with him hopping in his car and driving home drunk. Not a single person has even said a damn thing about his friend who was bar hopping with him, confirmed it to the police and media, but had no issue letting him drive home. So several steps of the way before the cop was ever involved in the situation this could have been prevented but we won't even consider that part of the equation.
