Of course, there are a lot of bad bosses out there.
In my case, If I were ever to be fired for wearing skins gear at work when half the folks at work are sporting cowgirl crap, there would be a suit involved the next day....
10 to one if it was a bears tie all would be good...

If there is no dress code, then if something got dicey under something under unlawful termination... it would probably come down to public standards as far as appropriate dress....
In most companies, a boss is not a god, does not have the right to tell you what color you dress in, and is answerable to someone higher than himself\herself....
Unless the boss owns the company or plays golf with the CEO... then you pretty much need to wear a chicken outfit if he tells you to....

if it is a employment at will state you are going to have hell with an "unlawful termination claim" your boss makes the rules and you play by them, plain and simple. unless those rules are a violation of a federal labor act (eeo, etc).

In a moderate to large company setting, I would say that there may be some management issues to be dealt with.
Of course reality has to play into this:
1. The company can make up tons of reasons for you to be let go that are legally correct but can be complete and utter bullshit...
2. That's also if the person who was been let go has the fundage\ability to pursue the crap in court.

I guess you guys missed the part where it says they had Bears advertising and paid $20,000.
How is that any different than working for Sony and wearing a Samsung t-shirt? It's not really, in my opinion.
The guy was being insubordinate. Period. I don't understand why people make problems then wonder what was wrong later? I am sure he is really proud for "showing him" who was boss.
