Legal advice regarding a friends Mach1

My sisters BF has an 03 Mach1 and is currently being fucked by Bill Utter Ford.
He brought his car in for a pcm issue, no codes no mileage and left with his engine blown and Utter trying to stick him with the bill for that, the motor and the labor. I can post the cliffs in a moment if needed.

Is there a legal route he can take?

"I went to nz and left my car with my father. It is a 2003 Ford mustang Mach 1. The car ran great and had no issues what so ever. I come back and we had to replace a cooling fan as it had become unbalanced and had torn it's self off the motor. The last night it ran there were 4 of us standing there looking at the car watching it run, we were waiting for the motor to heat up and turn the fan on. Sure enough it did and everything was great. The next day I go out to drive the car off and it won't start. The car refuses to turn kick to life and we pull the codes. It looked like a fuel pump issue. Tested the circuits and verified that power was going to the pump and could not find any issues. We replace the pump and get everything back together. I hook the battery backup and attempt to start the car....Now I have no miles and the car won't even turn over. Great, I attempt to pull some codes and the pcm won't even talk to me. Verified that all fuses were good and realized that we had a bad pcm, crap.



Under my father's advise we send it off to bill utter ford, little did I know that this would lead into such a nightmare. They started looking at the car on the 28th of October. They said yes the car has a bad pcm, so they send it off to be rebuilt because they could not find a replacement. Okay so that is $900 into the wind. So it takes some time and they call me on the 8th of NOV. They say that the car will turn on but it does not run well. They swear to me it's bad gas. Now if we remember the car was running just fine not two weeks before on the very same gas. Well they say this has to be the next step and that I have to get rid of the gas or they are going to charge me $400 to get rid of the gas ( they were going to have to drop the tank) Okay so I tell them again that it is not the fuel and that I will be back. So I ran the 1/3 tank of gas out and put half a tank of 93 in it. I also replaced the fuel filter and put injector cleaner in it as well. It still runs like crap. and now I notice that the fan was not kicking on. I verify the leads and fuses and everything checks out. I even jump a 12v to the fan and it won't kick on. Great well the dealership is 5 miles down the road and its cold so no biggie. I get the car back up on the 10th.



After having the car for a bit the dealership says that they are going to have to send the pcm back out. They do so and it comes back fine. They then tell me that the fuel pump is bad, They say that the pump's pressure is dropping off after 10 seconds and is causing the pcm to ask for even more fuel. They have tested this at the rails. When they tell me this I ask myself why in the hell this was not looked into in the first place when they swore I had bad fuel? Well now it's the 26th and we okay them to replace the fuel pump. They get around to replacing it on the 29th. Magically the car won't even start now. This time they tell me that the plugs have been fouled by all the fuel that has been flooding into the chamber and we also need to replace the oil. Uh okay fine the oil needed to be replaced anyway. They want to charge me $300 for the plug replacement, at this point I cannot do anything about it and let them do it, it is the 2nd. The 3rd comes and they call me and tell me that the head gasket blew out and the car over heated on them on the garage floor and spewed coolant all over the place. This happened while attempting to figure out why the cooling fan would not turn on. At this point I'm so overwhelmed that I cannot even get mad.



They said they did a coolant test and found oil and gas in the coolant. This was there verification on the head gasket being blown and why the fan never turned on. At this point I'm looking at having to spend 7-8k getting a new motor and getting it installed. I don't feel that I should have to pay for this and don't feel like taking the deal they offered of, we won't charge you for anything other than the cost of the pcm. What do you think should happen? I think I am going to seek legal advice on the matter, so if you know anyone that knows this situation well please let me know."

Yeah, I would lawyer up or perhaps just have a letter drafted and sent to their service mgr and the gm. That sucks, reminds me of the 6k allen samuels cost me when they denied my warranty on a 55k mile motor that spun 2 bearings.

Sounds like they were doing an idle test and forgot about it. Good luck, I loathe dealership service departments. I feel sorry for people thqt take their cars in for work out of warranty.

I say to go have a convo with the GM of the dealership. Forget even bothering with anyone besides him from this point forward. I'd also talk to a lawyer to see what they think.

Well, I can tell you what the problem likely was before this. It's probably the stupid fuel pump driver module. Fucker gave me fits on an 00 V6 that I have on my lot. As for what happened, yeah, lawyer up.

Make sure to have proof, proof, proof, and proof when trying to sue a big dealer like this. Anyone can be sued, but it doesn't mean the plaintiff is going to win. And there are a TON of Law Firms out there that can maybe view the case and see if enough to file a suit. Good luck!
