  • Insurance Question - Stolen vehicle

    Make a long story short

I had a 2007 Nissan maxima that was stolen. Vehicle was recovered the next day but was fucked up, items stolen from it. It had to be towed and went to a body shop.

    My insurance company is Allstate.

On the 17th, an adjuster went over my vehicle and looked at it.
Came back on Tuesday the 18th and deemed it as a total loss.

Now I have been talking with a lady who I guess is over the insurance claim.

Very rude, and a real bitch.

They have given me an offer from my car but its too low and I told them that.

I dont owe but maybe $5300 on my car.

I told her I can't even buy a car like mine for that amount.
All she stated to me was, we will look in your area and compare prices with an average of 10 vehicles.

I have been to a few car dealerships and found a car exactly like mine.
Miles are about 3k difference, but everything else is the same. All the same options, color, and everything. But it is a little more than my insurance company is offering me.

As far as value, Allstate is offering me about average trade-in value per NADA

Also I was told by the adjuster, that whatever price they come up with TTL or tax has to be added in that price.

What would you do and what is a fair value if it was your car?

Do you own cost market analysis of it. Search several ads in your area with vehicles similar to yours (options, mileage, etc.). Build your case and demand what you want. If the bitch still doesn't budge, threaten to demand a third party moderator to make the decision. Tell them as a paying customer, you have the right to be fairly compensated for your loss. Farmers went from $3600 before deductable on my dad's 91 coupe to $6100 after deduction within three days of me switching to dickhead mode.

When my truck was smashed 5 yrs ago, I ended up on the phone with the adjuster while sitting at the dealership I bought it at(and the next 2 trucks). My salesman printed the window sticker from my 05 and I had to go down the option list line by line to make sure they had everything right.

I ended up getting my price, not theirs - about $4k difference. Of course when the truck got hit it was only 10 months old/30k miles. With a 4yr old vehicle, I don't know how they would go about it.

TTL does not have to be added to it, only some states/companies add sales tax to the vehicles value for a valuation. You can push the company to come up with better claim numbers, but it can go both ways. Pushing can get more or less depending on the search radius and comps. Id at least try to talk to someone else or her supervisor if shes being a total PITA about it.

Switch to Geico...they gave me more for my cobra than what I could get private party when I totaled it in 09. I had Allstate back in 94-95...they suck.

Good advice, look in your area for comparable vehicles, same year similar options and mileage. It is in your policy that you can request a third party. If she is a bitch don't come back with the same, don't make any threats make promises. It is easier to catch flies with honey than it is with vinegar.

Most companies in this state add 6.25% sales tax and title fee, some will pay a prorated registration if pushed.

This won't help any right now or in the future. He wouldn't do any better going from Allstate to GEICO. You got lucky when you settled with them.

With my 01 Ranger, I was rear-ended by a semi while at a redlight. Ripped the rear wheels off the studs and threw them across 4 lanes of traffic. Their insurance company offered me 5k for her. I owed 4500.

After I went down the list of add ons, they offered to 'let me' keep the custom wheels. I said "For what? They're tore all to hell because your guy hit me at 55." Be an ass and stick to your guns. I got almost 7 in the end

That wasnt my first claim with Geico. The first was handled the same way. I guess I got lucky then too?

Claims specialist stated the price was $13,943.60 and deduct $500 for my deductible.

So a total of $13,443.60 without Tax and title fees.
My adjuster/investigator stated Tax and title fee would be added after a payout price was agreed upon.

I asked where she came up with that price and I was told they checked comparable vehicles and averaged the prices.

But I have been to a few dealerships that have the same year maxima, same options, color, mileage within 3,000-4500 miles of mine, and the lowest price has been $14,990 + ttl.

I had each dealership write up a buyers order for me, but the claims specialist said she would do another search and check fair value in my area???

That's why I suggested changing to a company that does give what you pay for...in my experience.

I had to do some arguing with Allstate, but when my car was deemed a total loss, I got more than I paid for it. Granted, I only had it for about maybe 2 months I think.

Just do your own research, get price quotes from a few dealerships, also go to a Nissan dealer and see what they show the value would be, get it all on paper and show the ins. rep.
