              Just a thought.....

              How would it differ if the thief ran into the guys house (unlocked) and was trying to steal $25 worth of personal belongings?

                  The castle doctrine may apply, but will be a sunuvabitch to prove/justify in court. The clerk was technically protecting property, but unless the perp was an imminent threat to his well-being, the response seems to be too much.

                      Grand Jury can still "no bill" this guy. Folks have shot (and killed) perps that were stealing from their neighbors here in Texas, and I don't see a lot of difference. Does the punishment fit the crime? I'd say it's a tad extreme.

                        Maybe they're caught up in trying to prove/disprove that the perp was actually trying to steal the beer in the first place.

                          Shoulda shot him in the knee cap or something to that nature if he didn't have a weapon. At least he wouldn't be doing anymore snatch and runs.

                          Maybe a bat to the head would've been a better response. Fuck thieves. They deserve whatever they get.

                            Difference is a house is a residence where the general public are not allowed unless invited. His bisuness is open to the public to come and go as they please during operating hours...

                            Breaking and Entering, vs legally walking into a public business and stealing something...

                                I say 'no bill' him. Buy him a beer, thank him for his service to the betterment of the community and hand him a sign for the front of his store showing the guy he shot with the words "Shoplifting, is it worth it?"
