            I don't want to see a guy die over a beer, but personally I think shoot to wound is a terrible idea.

            Shooting at anything other than center mass in the heat of the moment is a recipe for disaster. What if you miss and they harm you? What if you miss and the stray hits somebody/something else? Most people aren't trained enough to hit a moving arm or leg from a bench rest, much less in one of the most intense situations they have experienced when their adrenaline is pumping like crazy.

              Not to mention you would still have a bunch of litigation to go through considering that the lawyers will be mailing that man a SLEW of letters offering representation in a lawsuite against the store...regardless if a crime was being commited.

                If the clerks life was in danger then he did the correct thing, my life comes before yours and I will support the clerk 100%. Now if the thief was running away with his back to the clerk with nothing more than a 12 pack... The clerk is going to have to live with that decision and possibly pay the price for those actions.

                  I thought of that, and it certainly can and will happen, but can't they still bring civil action if you kill the other party? I've seen discussion on this but I'm not sure Texas law provides any protection from civil cases even if you are not charged criminally?

                    Killing a man over a 12 pack of beer who DID NOT DISPLAY A WEAPON......sounds like a bad idea. Thats a little OVERKILL if you ask me.

                      I think if it is covered by the castle doctrine then they CAN NOT bring charges too you. Otherwise, yes Civil charges can be brought up and force you into court. So you’re damned if you do, damned if you don’t....

                      The way I look at it, if the guy hadn’t put the clerk in that position...then we wouldn’t be having this conversation. We can say the clerk overreacted...but where is the book outlining how we should react to different situations? Yeah we have common sense, but there is obviously no place for that in a court room...we have seen this before. So playing by their game...

                      "I don’t know how this guy is going to react...so therefore I am going to tread lightly" is the mentality we should have. I guess the criminal figured that he would not get killed for stealing or attempting to steal a beer…I would say he “chose poorly”

                      Just a crap situation for both parties...I am sure the clerk was not thrilled to kill that man

                          The Castle doctrine is a defense to prosecution, not a preclusion from it. It all goes to a Grand Jury.

                              Ahh I see. I knew they were somehow related. (Thanks for clarifying Yale)

                              I mean it is somewhat useful to "monday morning quarterback" the deal but I always just try to figure out what I would do as best I can, and not worry too much about what they did. I know the plan often goes out the window when SHTF, but I try to prepare the the extent I am able. The only thing I know for sure is that I hope to never be in that situation.

                                Now it's over two cases of beer and the thief is a "known gang member", oh and Duve had an attitude problem. I'm glad I didn't have to pull the trigger but I can see where I might in certain situations.

                                Sure his life may not have been in danger but maybe he's barely scraping by and that two cases of beer hit his margins just enough to where he can't pay the rent and will be out of business next month? I know it's a stretch but when you steal from a small business you may literally be taking food off of their kid's plate.
