      You can change the locks legally as long as you provide access to the new keys 24hours a day. Doesn't specify where. Rent a PO BOx in Rockwall and leave the key in there. Put the PO Box key in an envelope on the back porch.

      You can do repairs to the AC if they need to be done. Sometimes parts need to be ordered and it could take a few days.

      You may have noticed the water meter running nonstop and tried to gain access but were denied. Since the dradbolt was locked you couldn't gain access. You turned off the water and locked it shut until you could get inside and verify the source of the leak. ONce inside you discover the toilet flapper wasn't down and the toilet was running.

        Truck in driveway backed up to the door. Note on the dash says "I rented you this truck to help you move since you can't seem to afford the rent. I have the keys so no one breaks in to it. The back is unlocked so you can fill it up. Let me know when you are ready to drive it. Call me" Turns off phone for a week.

                These people are pro's. They know patience will prolong things and work in their favor. This isn't their first rodeo.

                After "screening" 75+ people for my house (my first time), I was DONE with dealing with self-employed who would not/could not supply proof of income, people who kept bitching because I did not take Sec 8, and all other nonsense. I found going the route of a property manager was worth every penny. I still clear $200 a month net profit after their cut. (of course I put this back to build up reserves for future repairs) Only 2 people out of all of them filled out the app and NONE would put up the $25 for the background. I wasted a month or more of that. The mgmt company had it rented in 2 weeks. They listed the property in MLS, showed it, screened the apps, and if there ever is an eviction, it will cost me $250 and they will handle all that BS. If there is ever an issue, the property manager calls me to ask if I want them to call someone or give me the option to handle it. I have some good tenants right now, but next year they plan to move. I also wasted more money and time trying to do most work myself while trying to carry a full time job where I would have been better off hiring it out, writing it off, than what the delay of getting it ready actually ended up costing me.

                  There was a certain laid back approach on the part of both of us that in his mind was a green light for him to push the limits of the Landlord / Tennant relationship. Familiarity breeds CONTEMP, no doubt about it. However, embarrassing as it is to say, I have not had money to operate lately, and it has caused our arrangement to suffer in a big way. I was seen by him as an easier target than most if it came down having to take this matter to court. And indeed, that has been the case more often than not. Allowing him to use rent money to pay for repairs rather than rent due has most him a certain degree of power and confidence that unfortunately is working against me at this time. Kind of hard to enforce the on-time payment of rent when I am getting advances from him so I can hire contractors to get things repaired...

                  My neighbor tells me that they've got a water hose rigged up to aim water onto the compressor of the AC unit so they can run the AC with no fear of it overheating, or at least that's what my neighbors think is their logic. So they flood the back yard all day, then the water runs down into my neighbor's driveway and threatens to enter the garage, then veers off at the last moment until some other "obstacle" in the water path.

                  But Gosh Darn it, the AC unit keeps running like a freight train, froze up Aux fan and all !

                    His willful advances mean nothing in terms of timely rent payment, if a balance is due, then a balance is due. If he's not living up to the rental agreement, then it's time to go through the legal eviction process. At this point any promises that they are moving out mean nothing, and any further delay on the eviction process will only result in more lost rent. It seems to me that they've been in this situation before, know the drill, and have no intention on moving until they are legally forced to do so.

                      Besides, if nothing is in writing to back up that you told them they could use part of the rent for a repair or nothing is in writing that you required the receipts than neither of those claims would stand up in court. Nonetheless, if your rent receipts do not add up to the amount to have been paid per the agreement (from your bank statements) and of course they are not going to be able to provide the proof either, then the cards are still stacked in your favor they have not paid the rent and legal eviction should be all there is to it.

                      I'm not a lawyer but I've watched a lot of day time TV.

                        Dude, these people have been fucking you since day 1 with all those "repairs." They have done this before, cover your bases and go the legal route. You're pretty well fucked and will never see a dime at this point. Just get them out of the damn house as quick as you possibly can.

                            A good friend of mine just divulged some details about how his tenants burned his fucking house down. Insurance is done with their investigation now, so he just told me.

                                Wow.

                                That might end up being a good thing for him.

                                1. Getting to see the dirt bags thrown in jail for Arson.
                                2. Getting a check for the house and lost rent (depending on policy)
                                3. rebuilding the house how we wants to maximize future rental profits.
