Problem I see is you make the house payment an he buys beer with new found money. Six months from now it's going to be foreclosed on anyways. Also if he owes less then what it's worth why is he going to let the bank foreclose on it? Sell the damn place!

Ive seen lots of owner financing recently on cheaper properties, might want to talk to a real estate attorney and see how to do that.

Just do a lease purchase option. It sounds like what you want.
