            As long as what they are firing you for is not specifically protected, they can fire you for any reason. Whether you have a signed non-compete or not. Just like you can quit for any reason. That is the basic principle behind 'employment at will' (what most people confuse with 'right to work'). That doesn't mean they will not have to pay their portion of unemployment though.

                I understand it in some cases, but not others. I know a painter that did custom chopper paint out of his shop behind his house on the weekends. Everyone knew it, and the bodyshop would sometimes send custom projects (air brushing, flames, etc) home with him to do. He worked there for years, and one day the uppers called him in and told him his custom work was a conflict of interest and canned him. Nobody understood why.

                  Sounds like they wanted him out for another reason and used that as an excuse.

                    Well that is the thing, he had been there forever, had zero issues at work, went above and beyond anyone's expectations, never had come-backs, etc. He was a model employee. I ( and he, last time I saw him, he lives around the corner from me) didnt understand what the motivation was.

                      Some employers would suggest that any outside commercial venture is a conflict of interest and allow none.

                        If he had been there forever, then their motivation was probably, "Hey, we're paying this guy too much for something someone younger can do for much cheaper. We need a reason to get rid of him, so go dig one up."

                          That was the speculation. He had his wife he paid as a helper, and they ran 300+ hours a week through there. That's some cowskin rug money there...

                            Could be something as simple as he was there so long they decided they could hire someone new for cheaper, or it may have really just been what they said. From what I've seen and delt with, people are rarely fired for the actual reason given.

                              That is why my FIL gave up having employees that could do work without him in his HVAC business. Now he just uses a helper when needed.

                              All the missing supplies are hard to account for.
