Buying Used Truck

I'm currently looking at a 2005 Silverado Private Party Sale. The seller purchased the truck about 3 months ago & has the clear blue title for it but he never transferred into his name. Will it be a problem getting it transferred into my name if I purchased the truck? He said the previous owner did sign the title. Also, is there a way I can check for any liens on it?

If he has the title, it doesn't have a lien. No bank in the world is going to release the title until it has been paid off. Open title isn't a problem in Texas, if it was dated and never transferred, they will hit you with fees so check for that.

Please check it over REALLY good. That's typical of a flipper or someone who found out something that's about to fail and trying to unload it before it does. Make sure he has the I30U form signed by the previous owner (or whatever it is) or you will have a real hard time at the DMV.

There is a spot on the back of the title and if he dated it say 3 months ago, you only have 30 days to transfer it or they will start tacking on fees. Also, make damned sure that he didn't fill out any of the buyer details on the back of the title.

So basically it will have the seller details, which should be filled out already. Printed Name and Signature. Then it will have the purchaser details, which should NOT be filled out. If it is filled out, then you will have to get a statement of fact saying that the purchaser info is incorrect and have whoever's name is on the front of the title sign it. Also make sure they have the 130U for it.

So, here is a picture of a Texas title. The highlighted should be filled out with the name of the person on the front of the title and what is underneath should be blank.
