Need help with an insurance issue

    WTF are you talking about? I have a jeep, the upper and lower trailing arms were crumpled up like an empty beer can. You could see it just by bending down and looking and the sorry ass porch monkey though I was trying to pull a fast one on him. I just wanted what was obviously damage from the accident written on his estimate. I have always been fully aware that I can take my vehicle wherever I want for repairs but I thought that since he was being so shady about some damage that was so obvious then what was going to change once it was in the shop? If I would have continued the claim with his insurance company and they decided NOT to write a supplement check I would of been on the hook for a LOT more that $500. So it seems to me I did the right thing...

      like i said i was going out on a limb..
      they much rather work things out with the shop than the customer. and if it was obvious that the damage was caused in the accident, the shop you took it to(assuming you know and trust them) would make sure that those damages were paid for in a supplement.

        Send it back with a letter stating to make payment to your company as you've gone through them for repairs. I'd even go as far as sending it certified just to be on the safe side.

        The other company is going to give your insurace the run around stating they paid you for the damages. When your insurance calls you asking wtf, you have proof you didnt accept their rediculous offer and sent it back.

          Call the insurance companies back and say with attitude "so this is how you treat a man of color? Dr. King was right! I think it's time we protest your racist company and seek the reparations owed to us!"

          Then elaborate about their great great grandpappy beating your ancestors because they tried to make a claim for freedom, and it sounds like the insurance companies are trying to force you back into slavery and that is unconstitutional and un-American. Add to that you'll call the local fox station and the wb and Ofrah. If nothing else, it'll make you laugh as they jump through hoops.

          But don't cash the check.

            Send the check back to the other insurance company with a mail saying this does not cover anything and they should be dealing with your car insurance company directly. Send a copy to your ex-insurance company for their reference.

              Now this is the issue, since my insurance had to pay for the repairs and chase the other guys insurance for their money I had to pay my deposit out of pocket ($500). Well this entire time the guy who hit me will not respond to his insurance company calls and they keep saying that they can not find him so they can not pay anything yet. My insurance company says they can not reimburse me my deductible until they start collecting their money (I understand why and am ok with that). Fast forward to about mid December. A check from the guys insurance company shows up for the amount that they estimated ($1600). I call my insurance company and they say it no big deal and just say to send it back. Well I did not send it back and have NOT cashed it either, nor have I heard anything from either party since. I would like my deposit back, for you insurance know it all people here whats going on and should I just send this check back or hang onto it?
              SEND THAT SHIT BACK! While it is uncashed, it is possible a means to an end for this claim (for the at fault partys company) If you cash that check, it's instant settlement. Write void across the front and back...and send it in.

              Call and speak to a claims manager at YOUR company for any more follow ups from here out. Leave the other company alone, except for serving them with a small claims court notice for your $500 + court costs on the deductible

              Let your insurance worry about subrogating their own money. You won't see your deductible back from them.
