  • Newb Homeowner question

    So, some storms rolled through Abilene yesterday and wrecked shop... literally.

    A portable building was blown over/through some storage buildings, over a house and into my neighbors house/front yard. and part over it came across my yard and into one of my garage doors(wooden). I'm left with a gaping hole in the one door big enough to walk through. I've got it temporarily boarded up for now. Luckily none of my vehicles were inside, since I just moved in.

    My question is, is the owner of the portable building responsible for the damage? Do I just file on my homeowner's policy and let them figure it out? Do they assign blame in these situations like a car wreck or just pay to have the damage repaired?

    Thanks in advance for any insight. I'll get pics of the rest of the building in the AM.

    I was looking to replace them with metal doors, but didn't plan on doing it so quickly.

    Your deductible won't cover the $400-$500 damage done. I'm thinking he's responsible and his homeowners will cover it.

      Call your agent and ask what to file it under, and on who's policy. Thats some shitty luck though, or a sign you need new garage doors anyway.

        It's an "Act of God", the portable building owner isn't "responsbile" for his damage unless he was negligent in securing his property.

        OP, I wouldn't waste my time filing it on your home owners for such little damage. As stated it may be less than your deductible. If you file it and it actually is, the claim will still be attached to your policy, regardless if they paid out or not.

            I wasn't sure how much a new door costs. I didn't realize they were so cheap.

            And from what it looks like, the debris in the neighbors yard is the roof off of the storage buildings from a few blocks away.

                I would just look at it as an opportunity to up grade both doors to newer metal ones.

                  When the cause of the damage done by debris is due to weather, it would be hard to prove he didn't do everything to secure his property.

                  Just like if your neighbor's tree falls on your car during a storm. Unless the owner was negligent (tree was dead/rotted), his insurance will deny it.

                    The estimate for 2 new doors isn't too bad and isn't worth filing on my policy for. My other neighbor is going to pursue the storage building people to see about getting paid(he hada brand new fence wiped out). I've got a ton of pics of the damage and will pursue if it looks like they're willing to pay. If not, oh well.

                    The portable building was set out as a display in front of the storage buildings. The portable went through like a wrecking ball and the roof of the storage buildings lifted off and cleared a few other buildings and the house across the street before stopping in my driveway and my neighbors yard.

                    EDIT - the most annoying part is the constant parade of rubberneckers driving by to look at the damage.

                        I'll be getting insulated metal doors, a friend of the family quoted me about a grand for both doors installed.

                          Wait, I'm confused. Did the portable building that did damage to your property come from a residence or a business? If from a business, that probably changes everything. I'd pursue insurance from them if that's the case.

                            From a business. They have storage buildings that are permanent and then had one portable building that was set out as advertisement/demo.

                              Someone else may know better, but I'd say the business is liable here. Seems like negligence on their part. Good luck!
