From a strictly legal standpoint, as of 8 Nov, 2005, no marriage is valid in Texas same sex or otherwise.

Yeah I'm not a lawyer, but that change probably does not do what you say it does.

Marriage is not "identical or similar to marriage", marriage IS marriage. The intent of the law (as i'm sure you know) was to ban "civil unions" and other things similar to marriage that did not require "one man and one woman". (Not arguing for the validity of the amendment in 05, but courts are not going to void all marriages in TX.

They were wearing identical coats.
The boxes were identical in shape.

I've no doubt that the Marriage clause in the states constitution will be ignored and your friends will have no issues getting married.

Just wanted to give a heads up that no marriage is legally recognized in Texas, regardless of whether or not it's enforced or enforceable.

I'm ordained through the Universal Life Church.. Took like 5 min years ago. At the time it was free, but you could pay for wedding packages and stuff that would give you ceremony scripting, clergy ID and stuff like that.

I think you're still missing the whole point of that. Marriage is still recognized as a legal status, and it is strictly defined as the union between 1 man and 1 woman. That second part (b) is so that people can't get around that by calling anything that doesn't meet the definition in part (a) something else to create a legal status that would be equivalent to marriage.

I'm not missing anything. I know why they did it. I get the intent. That doesn't change the fact that marriage is identical to marriage and is therefore not able to be recognized by the state of Texas. Intent only carries things so far. What they did is what's important.

After all, on 4 Aug, 2010, California's ban on gay marriages was ruled to be unconstitutional. Making the limiting marriage, in the way that was intended with the wording, is not enforceable any more than a religious litmus test is when running for public office. That's why I explicitly stated that it would be ignored regardless of whether it is enforceable or not.

However, from a strictly legal standpoint, the Texas constitution forbids it from recognizing anything identical to marriage. Coincidentally, marriage is identical to marriage preventing it from being legally recognized by the state, per the state's constitution.
