    Iraq War vet armed with rifle thwarts gas station break-in, police say

    SHINGLETON, Mich. – Police say an Iraq War veteran thwarted two would-be burglars at his northern Michigan gas station by kicking one of them and ordering them away with an AR-15 rifle.

    State police said Shawn Schank was inside the gas station about 4:10 a.m. Sunday in Shingleton, an Upper Peninsula community in Alger County, when two people wearing ski masks forced their way into the building and approached the cash register.

    Police say Schank kicked one of them, retrieved the AR-15 from his office and ordered the burglars to leave.

    Police say one of the burglars took off his mask and pleaded with Schank not to shoot him before both suspects fled on foot.

    Police say they arrested a 17-year-old from Shingleton and an 18-year-old from Munising. They're jailed pending charges.

    Good on him. He'd have saved taxpayers a bunch if he'd have shot them both but...sometimes trigger discipline is best

      So you approach them in a threatening manner with a rifle, they plead for their life, you let them go on the good nature they will not return or won't have a friend return only to shoot you in the face? Sounds legit.

        WTF are you talking about? I said I would NOT have let them go, I would have held them there at gunpoint until the popo showed up.

          And another, I love these stories.



          Two of the three suspects arrested in connection with an attempted robbery that ended with one of the suspects getting shot, made their initial appearances in Yuma Justice Court on Tuesday afternoon.

          Jesus Bernal-Rivas, 19, and Angel Estrada, 21, both of Yuma, were informed by Yuma Justice of the Peace Greg Stewart that they were being held on allegations of attempted first-degree murder, armed robbery and aggravated assault with a deadly weapon, all felonies.

          Stewart also explained to Bernal-Rivas and Estrada that they would be returning to court at 1 p.m. Thursday, when they would be told if prosecutors had filed a criminal complaint against them, charging them with any or all of the offenses.

          "State prosecutors, by law, have two days to review police reports, and based upon that review, they are going to decide to file formal charges against you," Stewart said during Rivas’ hearing. "I will not know that until you until you appear back before this court two days from now."

          During Rivas’ hearing, prosecutor William Katz, of the Yuma County Attorney’s Office, asked the court to set a $500,000 cash-only bond, saying Rivas is considered a flight risk and was on probation when he allegedly committed the offense.

          Katz went on to tell the court that Rivas was the alleged getaway driver in the crime and waited in the car around the corner while Estrada and his brother approached the victim.

          "The victim was in town visiting a family member and was standing outside a residence when he was approached by two males," Katz said. "They demanded his wallet, when he didn’t comply, they demanded his wallet again. It was at that point that they brandished a weapon and (the victim), himself a gun owner, took out his own .45-caliber weapon. Refusing to be a victim, he fired and struck one of the assailants in the neck."

          After running from the scene, Katz said the Estrada brothers ran back to the getaway car and Rivas drove to Yuma Regional Medical Center, where they were later arrested. He also said, in addition to the car being covered in blood, a blue bandanna, which the victim said one of his assailants was wearing, was seen in plain view inside the car.

          "The defendant is the registered owner of the car that is found at YRMC, where he dropped off one of his accomplices who had been shot in the neck, given there is a blue bandanna found in plain sight, and given that this defendant confessed later on to law enforcement and said that they had simply gone to take down this man so that they could get a wallet because they needed money," Katz said in asking for the bond.

          Attorney Richard Edgar, who is representing Rivas, argued against the cash-only bond amount, calling it outrageous and completely egregious, instead asking it be set around the $15,000. Edgar also said that not enough information has been presented to court yet to indicate his client committed any of the offenses he is being held on and that additional information will likely be provided to the during the next hearing.

          "While the defense would agree with a portion of what the state claims, the facts remains as this. There was a person who was shot and it’s not the alleged victim in this case, it was one of the accused. That person is currently in the hospital," Edgar said. "In addition, there is no allegation that my client held a gun, there is no allegation that (Rivas) had anything to do with the actual assailing of anyone. He just drove somebody to the hospital."

          While Stewart did not set cash-only bonds for Rivas and Estrada, he did grant the state’s request on the bond amount, setting it at the half-million Katz had asked for.

          Shortly after 7 p.m. Monday, officers responded to Desert Palms Mobile Home Park, 500 W. 28th St., for a report of an attempted robbery with shots fired.

          When officers arrived, they located the victim of the robbery, who said that two males had approached him as he stood in front of his trailer, and demanded money.

          The victim said one of the suspects was armed with a handgun, which he displayed toward the victim. The victim was also armed with a legally concealed handgun, and upon being threatened, the victim and the suspect exchanged gunfire. The victim struck one of the suspects during the exchange of gunfire, at which time the suspects fled the scene.

          The victim was not shot and was not injured.

          The suspect who was shot was taken to YRMC by his accomplices, where he was treated for a life-threatening gunshot wound. He was later flown to Phoenix for further treatment.

          The two other alleged accomplices were located by officers, arrested and booked into the Yuma County jail.

          The Yuma Police Department has not released the names of either the victim or the suspect who was shot.
