Just playing devil's advocate but how do you know he was speeding? A truck that size accelerating to 35 mph could definitely sound like he's speeding. Should he file a similar complaint about your dog getting out?

Not trying to be an asshole, but that's basically what it comes down to...like you said, shit happens and it was your dog/responsibility.

If your wife kept the dog in the house like she was supposed to, none of this would have happened. It's her fault, don't confuse that with what happened after the fact. That's not an excuse for the driver not to stop though, that's bullshit.

Speed limit is 30 and you can tell the difference between that and say 40(my wife and a neighbor who saw this all happen estimates of his speed). Most people who live here drive 30 or less but there are plenty of people that visit that don't

Why was your wife out of the kitchen? I kid I kid.

I feel bad but it's the dog owner's responsibility to keep the dog under control at all times. The dog got out and was hit. Lesson learned...

Let fedex and UPS speed, I want my packages early damn't!!!

If he was in fact speeding, then yeah, I understand your frustration. I wonder if those trucks are equipped with GPS devices where they can go back and review his speed and at least get him for speeding. I've heard of trucking/cab companies that can do this.

Hopefully your dog is ok. I know how some people can become attach to their pets like children so I'm not trying to bash your emotions towards your pet or anything. Just throwing my previous post out there before you get someone in trouble just because he didn't stop (not everyone gets attached to pets).

Anyway, I know my perspective on this situation won't help any so I'll shut up.

FedEx driver could have been going 200MPH, and it's still the dog owners fault for not having control of their pet.

Not trying to sound like an asshole, but that's the truth. And that's how the law would interpret the issue.

The only thing FedEx did wrong was not stopping. But with a big, loud truck, he might not have known he hit it. You would have a hard time proving otherwise.

                      Sorry about your dog, OP.

Yeah, ours gets going pretty good - but not sure he exceed the speed limit. Although it always makes me look cause that's one thing mustangs and FedEx/UPS trucks have in common - they make a lot of noise but are not really going very fast.

Hey look I drive an oversized box truck and deliver peoples stuff, so hey look I am allowed to speed through neighborhoods and break traffic laws because I can't manage my time correctly and if I do something wrong, other people should take it as lessoned learned on their part. LOL

Maybe the drivers should take note on their regular route and be more careful and take responsibility, just a thought.

Pretty sure in drivers ed and I know in the MC course they drill it into your head that a kid, pet, ball, or whatever could come out of nowhere, so pay attention.
Can't imagine they don't do this in the "now I drive a big box truck class". lol
