What the judge did or didn't do at that hearing has absolutely no effect on his appeal. It appears the judge wasn't very versed on how to handle that type of post-conviction hearing. It was almost like he got confused and thought it was an arraignment hearing where a bond can be set. It's not uncommon for judges in small towns to make mistakes on procedural issues like that. Lord only knows when the last time was that he had a hearing like that or if he'd ever had one before. Trust me...I've had to educate a few small town judges over the years.
