Talking = Drunkenly shouting and using obscenities in public. It sure sounds like "talking" when you are drunk... But everyone around you knows you are shouting... Unless you can get some very reputable witnesses that can attest to everything you are saying to the letter, or a video proving what you are saying, then it will become your word against the officer's, and you will lose in court.
"Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes...Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man." - Thomas Jefferson, 1776

The reason I'm upset is because I wasn't swing my fist or threatening anyone. Me and that guy were walking away from each other. The cop without saying anything took me down and right side of my face is all messed up. An ambulance did have to show up and clean up from all the blood running down my face. That was causes by the cop.

Ummmmmmmm okay? If you are trying to say what I think you are trying to say, quit drinking in public. It sounds like you don't completely know what happened as your story keeps changing. You will continue to get in bad situations if you keep giving yourself the opportunity to be in those situations.

I only drink at home or at a few of my friends and family's homes. I do take my wife out dancing at a bar/club every now and then, but I won't drink until we get home. I don't like being in public places without my wits about me.

I'm not 100% if the incident I saw was yours or not, but it sounds like a match. Anyway, the two idiots I saw were the most obnoxious 2 people I saw all day. When the first cop hopped the rail, he gave very loud and clear "stop or I'll mace you" commands. I didn't stick around for the aftermath, because I didn't want to be downwind of any potential macing, but the dummy causing the problems deserved whatever they got.

No that wasn't me. I never saw the cop, he blindsided me. I knew it was a cop, cause of handcuffs, I stopped moving, but did ask why I was being handcuffed. He just kept his knee on my back and he hand on my back of my head against the ground and told me to shut up.

Will you just admit you don't completely know what happened. Filling a complaint would be pointless as you can't even get your story straight to us.

I was arguing with some guy yesterday, we weren't fighting just talking shit to each other. A Dallas cop from behind, threw me down. At first I thought one of the guys friend I was arguing with was jumping me. he slammed my face into the sidewalk, busted up my face, black eye, slash on my forehead and burn marks on my cheeks. I spent the night in jail and got PI, but I think he used excess force, didn't warm me or try and break me and the other guy up, just grabbed me from behind.

                          Do I have a case?

The cop never was in front of me or ask me to calm down. like I said he threw me down from behind without warning or anything. I'd understand if I was fighting, me and this guy weren't really close. we were just talking trash about ten feet away.

talked to a lawyer today. i cant really do anything about the cop because in his eyes I was a danger to myself or anybody around just because he said I was drunk. He could have tazed me if he wanted. Now if the bruises, cuts and blood stuff would have happen after he handcuffed me, it would be different. They are going to get the ticket dismissed or reduced and it wont go on my record.

Lesson learned, walk away and drink at home more often.

They are going to attempt to, but being your second offense they may tell you to pound sand.
