    Ok, one of my brothers sold an '04 Mustang GT about 2 years ago. The guy (living in dallas) bought the car, and apparently he never transferred it into his name. I just got a letter in the mail from the Oklahoma MVD saying that it was abandoned in Lexington, OK. All we have to do is call them and tell them that we no longer have a financial or legal interest in the car, and it will be sold as a scrap/lost title car. If not, we can buy it from the holding yard for $2000.

    Since the guy just ditched the car, do you think it is reasonable to buy it back and file for a lost title?

                  Never heard of anyone ever giving previous titled owner "first dibs" before a car goes to auction.

                  This doesn't pass the smell test. In fact it sounds shady as fuck.

                        Title was never transferred. This happened to my brother in law, yard offered him to come buy it for the amount of the lein. He said no thanks, they then offered a discounted price. Went and looked at it and it was beyond hope for getting it fixed, so he passed.

                          $2k? I'd ask for a fee schedule for nonconsent tows. How long has it been in storage? Did the company notify the previous owner in accordance to state laws? In Texas, the first notification letter has to be sent to the last registered owner, and lien holder if any, no sooner than 24 hours after it was impounded and no later than the 5th day after it was impounded. Just based on what we can charge (state mandated), 5 days is around $400. Now there's other things that can be added in there such as fees for being towed as a result of a police department tow, but even with that $2k sounds a little steep!

                            Just remember if the guy that you bought it from were to get wise to it, it could get very nasty for you. Basically forging a government document, stolen car etc.

                            Maybe a bonded title if it was worth getting? I would check with the tax office first though, still might be sketchy.

                            Other wise it would have to be sold at auction.

                            May have been some kind of fucking DWI wreck and totaled out and the guy hauled ass. That would still qualify as abandoned.
