        went to a bbq joint in denver, co. that charged us (a party of 5) 20% gratuity! we were pissed off and it wasn't very good the shit was cold

          I've never waited tables before but if there's a big table, that's lots of people and they're having to devote quite a bit of time to just your table, so they aren't available to wait other tables hence losing out on possible tips. I don't see a problem with mandatory tipping amounts as long as it's reasonable.

                    You don't have to pay the gratuity. Our menu says 15% on 8 or more but we always leave it up to the customer. Our servers always come out ahead.

                        You know that the servers do not make the rules, right? They have to follow what the company says to do. You wouldn't only pay $10 for a $30 steak just because you didn't like it. If the cook prepared it the way it's supposed to be prepared and the server did their part, you should pay the price that is listed on their menu. Automatic gratuity it always shown on the menu if it is their policy-it's not a surprise.

                        Oh, and it doesn't take the motivation away-that encourages you to do better and get a tip above and beyond the auto grat.

                              I would not pay anything for a steak if I didn't like it. I would not tip if a waiter/waitress gave horrible service. I do not expect a restaurant to give five star food, but if the food is horrible or cold, or takes an inappropriate length of time to get to the table, it isn't my fault. While the preparation of the food isn't the fault of the waitstaff, they are still responsible for it and can make up for it in several ways.

                              Big "if" there. A tip is not a pre-negociated gimme, it is a bonus given if the customer is satisfied with the service given. if the waitstaff does a satisfactory job, they are given the tip, if not, the tip is withheld. When the tip becomes mandatory, there is no reason for the waitstaff to give satisfactory service. Not only that, but there are various levels of the quality of service, and each level can and should be rewarded with an appropriate tip. Setting a manditory tip removes the ability of the customer to reward the waitstaff for going above and beyond the usual service.
