I wonder what MPD considers faulty evasive action??
          Hang him by his nuts.
I had a drunk on a bike rear end me at 120+, they tore that truck upside down looking for any thing wrong.
Never mind he had a BAC of .25 going over 120 mph. Went over my phone logs, my log books you name it. It was two weeks jumping through hoops to get cleared.
Dumb ass cop tryed to give me a ticket for my brake light bracket bent back.
His Sargent ask him if may be a bike hitting me might have bent it. He hit my tandem so had blew out the tires and bent the rear end..

Albert used to get beat up by christina straight up punk. When he closed his shop down he didnt bother to tell any of his customers and left there cars in there. If it had been for rick towing them back to the customers houses they all would have lost them. There is alot more dude has issuses

probably some bullshit that a cop made up. maybe he came up on a light and couldnt stop so he steered it left and it rolled. i suppose that could be considered evasive action. espinosa is dumb for ever getting back in a truck after that. i know i never could

its your fault man watch out for the 150mph sport bikes!! i have a crash on my mvr for a tire blowout because someone ran over a piece of the tire. it also lists failure to maintain equipment. cops will do whatever they can to try to ruin your record.

I was friends with him back in the day. He was a good dude and was a safe driver. (For a mustang driver that is.) Last time I saw him, his Dad had a construction company and his brother helped out as well. The had 6 trucks at the time. I am pretty sure when Albert started driving that day he didn't know which truck he was driving and that brakes were going to fail.

The argument can be made that if the truck wasn't serviced requarly like found by the DOT then anyone who is involved in a wreck can be found guilty. My mom the other day got into a fender bender with another car on 190 service road. It was wet out, just enough rain to bring up the oil out of the streets. The car in front slammed on the brakes, my mom slid and tapped the car in front. Didn't even trade paint. The other driver called Richardson Police and my mom got a $200 fine for causing a road collision. Not being involved in one but the Main Cause.

He will probably get probation but the whole thing is fucked up. The case went to trial after five years of court delays, new judges and five prosecutors. That tell's you right there its a witch hunt! Prosecutors only take cases they can win, this case was a looser until they scraped the bottom of the barrel for a judge and DA to try the case.

This is a bummer, I hope you guys keep your brakes serviced!
                    That's funny.

So...is that a 5 year probated sentence with $1000 fine and a few days in jail? The "two year's confinement" threw me off.

He has to serve 2 years state jail, then start a 5 year probation sentence. During probation he will be paying restitution to the victims of crimes and whatnot.

Yes. They gave him two years state jail, but giving him 5 years probation instead of sending him away.
