I was friends with him back in the day. He was a good dude and was a safe driver. (For a mustang driver that is.) Last time I saw him, his Dad had a construction company and his brother helped out as well. The had 6 trucks at the time. I am pretty sure when Albert started driving that day he didn't know which truck he was driving and that brakes were going to fail.
The argument can be made that if the truck wasn't serviced requarly like found by the DOT then anyone who is involved in a wreck can be found guilty. My mom the other day got into a fender bender with another car on 190 service road. It was wet out, just enough rain to bring up the oil out of the streets. The car in front slammed on the brakes, my mom slid and tapped the car in front. Didn't even trade paint. The other driver called Richardson Police and my mom got a $200 fine for causing a road collision. Not being involved in one but the Main Cause.
He will probably get probation but the whole thing is fucked up. The case went to trial after five years of court delays, new judges and five prosecutors. That tell's you right there its a witch hunt! Prosecutors only take cases they can win, this case was a looser until they scraped the bottom of the barrel for a judge and DA to try the case.
This is a bummer, I hope you guys keep your brakes serviced!

MCKINNEY — Alberto Espinosa, of Plano, was indicted by a Collin County grand jury Tuesday of criminally negligent homicide according to court documents filed in the 380th District Court of Judge Charles Sandoval.
Criminally negligent homicide is defined as causing the death of an individual by criminal negligence. The offense is a state jail felony, a sentence which normally carries with it a probated sentence. It should be noted, however, that judges have at their discretion the ability to sentence offenders to up to two years in a state jail.
The case stems from the April 30, 2007 motor vehicle accident which claimed the life of McKinney resident LeAnn Selkirk. At approximately 7:05 a.m. Selkirk, who was southbound on 400 N. Custer Rd., was stopped, her gold Infinity QX4 preparing to make a left turn into Sonic. Moments later, a commercial dump truck driven by Espinosa crashed into her. Selkirk was dead at the scene, crushed by the weight of the overturned dump truck/semi-trailer tandem.
The commercial dump truck was driven by Espinosa, 28. The case was turned over to the grand jury on Dec. 10 following an investigation by the McKinney Police Department and a separate investigation of Espinosa's vehicle by the Texas Department of Public Safety. MPD noted faulty evasive action and defective brakes on the dump truck/trailer tandem driven by Espinosa, as key contributors to the accident. The accident report indicated a “partially inoperable braking system which contributed to the cause of the accident.”
Selkirk, 26, was pregnant at the time of her death. She was a kindergarten teacher in Anna.

When I was 16 years old, my mom bought me my first car, 1966 mustang for $1700. It wasn't in the best shape. I was fixing it up while delivering pizza and going to school. One day while driving on 635 my brakes went out while exiting on a down hill off ramp. The pedal was to the floor and I have been driving for 4 months now. As i was coming up to 4 cars stacked 3 lanes wide I knew this was going to hurt! I threw the car into park, the teeth just chattered and I didn't loose any speed. I then downshifted into second, this dropped me from going 55 to 35 mph. I hit first and that got me down to 20. I yanked on the e-brake and jumped the curb. A big phone poll is what stopped me. BOOM!
I had the car towed and brakes fixed. Could have happened to anyone in my situation. It was just a older car at it was that time the brakes failed out of no fault of my own. Now I had enough time to react and got lucky. Some people aren't that lucky. Bad luck now equals prison time in Texas?

When the brakes fail on a truck it's usually a loss of air. When you lose air the parking brakes apply locking up the wheels and causing you to lose control. At that point if you're moving the only wheels that won't be locked up will be your front(steer) axle tires. There are 2 gauges in the truck to show air pressure in your air tanks. He knew something was wrong.Last edited by Adam; 12-08-2012, 06:43 AM.-2013 Mustang gt.

Looks like this forum is mostly posts towards someone else. Pretty lame for grown men.
