no kids. in the agreement she gets the house and has to assume the loan blah blah. but shes emailing me telling me that she cant get it refinanced. so what do i need to do to get my name off that place and off my credit so that i can get a new place?

You cant get your name off the loan unless you go to court & have a order for it.

Adrian & her Ex Husband are in this same deal & her name is on the house yet he lives in it & she took her divorce papers to the county & filed & called the loan company & they said there is nothing they can do till he gets it re financed

Also, nice little thing I learned in my divorce that will serve you here. Even if she was awarded the house, if your name is still on it, YOU are STILL responsible to the creditor. I know it sounds crazy, but trust me, it is true. You need to do whatever you can to get it out of your name ASAP.

damn what a headache. i am supposed to sign a special warranty deed but if i understand this correctly that wont actually remove my name from the house.
