I'm not a lawyer and your mileage may vary.
It sounds to me like no one has actually filed the will and sent the estate to probate.
If the grand mothers house is $6k behind on taxes, then the estate has not been settled.
So, the will has not been filed, because probate would have settled that debt, or made an
attempt to settle it through estate liquidation.
So, outside of a filing of the will and probate actions, the estate would pass to the
children of the grandparents. The children of the grand parents simply need to present the
pertinent death, birth, and marriage certificates to the holders of the estates properties
to transition the assets. The house/property will not transition until it is free and clear
(pay all backtaxes).
Same for any of the grand parents estate assets like financial accounts, cars, etc...
It is not necessary for the will to be filed, if all pertinent parties can come to an agreement
on how to settle the estate.
It is possible that Adrian can file the will, if she has a valid/legal copy. Then the grand
parents estate is sent to probate to be settled. Adrian has a legitimate claim to the
grandparents estate being a blood sibling to the named benificiary listed in the will, but will
likely need legal representation to make her claim in court.
Material change to the family circumstances after the date of the will.
The will is the intention of the grandparents estate settlement, but it cannot
remove the blood relative's right to lay claim if it's legal and legitimate.
The court will see by the date of the will and Adrian's birth certificate that the claim is
legitimate and would be entitled to an even share of the settled estate if the state is to
follow the directive in the will.
There's a lot required for a will to be valid and legal. If the estate is sent to probate the
will may even be found to be invalid, then the state will settle the estate and the proceeds
will pass to the children of the grand parents, all with even share.Last edited by jayjohnson600; 11-16-2012, 09:02 AM.Jay Johnson

Don't feel to bad, my wife was supposed to get a cool million when her grandmother passed.
Instead the oldest son of gma got her to re-do the will on her death bed so he got 40million, his siblings got 250k, and the grand children only got 1000.
Talk about a nasty lawsuit that followed...
Karma was a bitch and he died about 8 months after gma died. Lawsuit got settled and the siblings(6 total) got the 2-3 mil a piece, while older brothers two kids kept the rest. Grand children got squat."No free man shall ever be debarred the use of arms. The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government"

Is this why you got all mad about the price of a set of head bolts?

She could have left the house to her dear little doggie or a nurse or the church, whatever... Sure, it sucks to be left out, but she's not entitled to anything. If the sister that is given the house doesn't feel its fair to sell it and whack up the proceeds evenly, I would remind her of that the next time she has her hand out.

She spent 4 years in school busting her ass to get her degree & she feels like her sister gets all the handouts while she works her ass off. I get it & why she feels the way she does.
The mother has been on disabilty her whole life & hasnt worked in 30 years. They mouch off the goverment everyway they can & Adrian is already pissed at people who do mouch off the goverment cause its her tax dollars paying for it. They take out right at $600+ every two weeks from her check while she works 12 hours shifts at the hospital in Oncology
