House + marriage + divorce question

OK, I bought a house when I was 23. I’m now 36 and only owe about $40k on it. It is worth about $100k. If I were to get married and it didn’t work out, would the ex be able to take half the value of my house. It’s not like I have a net worth large enough to look into a prenup , but I’m wondering what the outcome would be if the girl I married did get divorced.

Disclaimer, never been married, not really looking to get married, just wondering what the repercussions might be if I decided to get married and it didn’t work out…

If she lives in the house for a specified time period (I think 1 year) then it is considered her homestead and it becomes very confusing (because Texas is community property). Depending on the divorce settlement she could get half the value, half the equity while she was there, or nothing at all if you can prove you paid for everything - that last option is an asswhip to prove though.

I'd talk to a good real estate attorney.

You need to protect your existing equity with an agreement before you get married. As soon as you use one cent of common property money to make a payment on the house then she is going to have a claim against it.

It almost seems like this is too much trouble than it's worth. Although talking to a good real estate attorney beforehand might clear up my confusion. That's prolly the best advice I will get on this.
