I've setup call centers for debt collectors, but don't really know their job. Do they get a percentage of their collections? Otherwise, what is their motivation to be pricks? Born that way, just to keep job or for commissions?

They buy the debt for pennies on the dollar, which is why they can negotiate the debt down, but the callers themselves generally get a (large) commission from the debt they collect.

        Pot, meet kettle.

And did you ever figure out how a business that employes minimum wage workers, can continue to have the same work force size at 20 dollars an hour while keeping prices the same and paying higher taxdes?

          hypocrisy, not hypocracy

One would think that a poster who considers himself superior enough to refer to the membership as "one way fucks" would have the common sense to at least spell the words in his run-on sentence correctly.

If that's true its fucking ridiculous. If it's true.

I am not at all surprised you can't spell that.

This is the exact reason why I would never give a debt collector the time of day!

                  x2

Company could be full of shit but they claim no one knows the time and numbers called. You know a lot of places have recorded lines and they can look that shit up and listen to it. I know when I had a problem with a certain company some one was able to pull up my number and listen to past calls.

                  Statement of Gurstel Chargo
                  October 15, 2012

We learned late last week of the lawsuit filed by Michael Andrew Collier and Kim Collier-Dingman. Gurstel Chargo takes the allegations made in the lawsuit very seriously and we have immediately launched an internal investigation to determine the facts. We are extremely disturbed by the allegations stated in the Complaint, as they are contrary to the policies, practices and values of our firm. We expect that all Gurstel Chargo employees fully comply with all state and federal laws, and we thoroughly train our employees to perform their job in a lawful and respectful manner. Under no circumstances does our firm tolerate the type of conduct alleged in the Complaint.

The Complaint states that the wrongful remarks were made during a telephone call. We have requested from the attorney that filed the Complaint the phone number of the phone that Mr. Collier was allegedly on, an approximate date on which the call occurred, whether the person who made the alleged wrongful comments was male or female, all in order to help us to get to the truth about what occurred. We have been informed by Mr. Collier's attorney that he is unaware of any of this information. To date, we have discovered no information to substantiate the allegations, but our investigation continues. Should these allegations prove to be true, we will take immediate corrective and disciplinary action.

Well, if they don't know the agent, called number and especially the date that looks really bad on the people filing the lawsuit in my opinion. Called number or date should be enough, called number without a doubt. Unless, it was an automated outbound campaign and the plaintiff called into the call center. Either way, his number is crucial. Even if all calls were 20 seconds long, some of those calls centers have several thousand calls per hour and it would be nearly impossible to listen to all the calls. A lot of call centers have a 2-5 minute average call length though.

At a minimum, the plantiff should know the phone number he was using.

Of course, I'm not a lawyer either - so this maybe a tactic on the lawyer's side. As a lot of times call recordings are not kept all that long or archived. Just depends on fed/local/business requirements. So they maybe waiting for those recordings to expire and then provide the information...etc...etc.

I'd be doing some upgrades to the call recording server(s) and archiving everything at this point and using that going forward.

Generally, any company who does 90% of their work over the phone has the calls recorded. In my previous job I made sure that our Tier1/2 helpdesk had their calls recorded because i always got people complaining about how someone was abusive or said "something" that offended them. We went back to the recording, listened to the call and never found anything. When we presented the recorded call back to the user who complained (and her manager/owner who she complained to) there was always a certain satisfaction in fronting out their lie and watching them squirm.

Debt collectors likely have the same system so when someone "agrees to pay" a debt, they have proof of it and can leverage it out. We kept all calls for 180 days just to cover our ass. Storage was cheap.
