Your insurance may have a damage limit of some sort to where they will not hold an accident against you unless it's over a certain dollar amount.

I hate down town Midlothian because of those parking spots. You can tell who lives here that drives carefully and who is passing through by the speed of them driving through.

Tio Tonys has decent breakfast, Fajitas bout the only good thing there.

I like Hideout burger, and Capuzanos.

"failure to control speed", driving too fast for conditions. But common sense rarely comes into play with insurance

LOL... if the roles were reversed everyone would be bitching about the asshole carelessly pulling out of a parking space...

Yep, especially on private property. Tell her to get smoked.

              Probably.
Could always push for Driver 2 driving too fast for conditions, distracted, etc.
It probably won't work out that way though.

No private property... you basically park on the street. All the spots are angled so you just pull in.

Yeah, a lot of old towns have that around here and it is nice - more spots overall. It really is not that hard to keep an eye out for people trying to back out. Saves everyone a hassle.

Problem is some people here just put it in R and start going. You cant always see a car thats next to a big truck till its to late.

I can honestly say I was not carelessly backing out. I saw her, I stopped. She was focused on her phone conversation. When I walked up to her, she was still talking on the phone. In fact I got tired of standing in the rain waiting on her to get off the phone and walked back to my truck to wait on the police that I called.

But yes, I will still be at fault.

What is funny, I watched plenty of people backing out while I was waiting on the police and people coming down the street watched out for them. Some stopped and let them back out, some people backing out stopped just like I did and the cars simply drove around. I did not see anyone locking up their brakes or driving near the speed this girl was.

Shoot, I would agree to this, especially if I could take care of my damage and see take care of hers. I would go for that in a heart beat.
