When I worked at Oncor reading meters, i dialed the police about 5 times a day with the phone in my pocket. The were very friendly for the week it happened.

I don't know, but if I heard that and no one fucking answered the door when you arrive wouldn't that give you a clear concise idea that something may not be quite right?
This was a cell call and the address was an "associated" one. They could have been anywhere when that call was made. If you lack exigent circumstances, then you just committed an illegal search.

This job is just a tad more complicated than you think.

Now I'm confused. Do we want cops to bust down the door of an unverified address or not? What if there was a pit bull (with cropped ears of course) inside and they had to shoot it? Quite the conundrum.

Gotta go with bonehead this time. It would be different if the call came from a landline in the home, of if she stated that she was at that address.

Also, if they went to the house and things were quiet, I bet she was already dead. And heck, he was probably already gone. They caught him soon after, so it's a wrap. There's no story here other than another murder with a suspect in custody.

I'll take "bonehead" as a term of endearment.

I think the city just might eat it on this one. I think it might be borderline but once the totality of the circumstances are added up, they should have gone in. Someone should have realized there was a prior criminal history in regards to him beating on her before, and this particular call fit into that same category. I think it'd be different if it was a silent 911 call, but there were 2 calls in this case and one of them is her describing an attack. I'm wondering just how "associated" the address was.

Yes, but remember they had to consider the "totality of the circumstances" at the time of the call, not an hour, day, or week(s) later.

It will hinge on what information that they had that said the call was coming from that particular address. If they checked, and nothing could be found, they did all that they could do.

An unfortunate story, but the call could have been made from anywhere. Had it been on a landline, i can see knocking the door down, but as it was a mobile....I don't want my door kicked in because someone gave them my address and claimed something was going on. Check out the term "SWAT-ing."

I see a payout however to the family because this is a PR nightmare

I'm willing to bet that they'll be cleared internally but the city will make a payout.

                                Of course.

One can follow every rule and procedure and still be sued. No city council member will deny a payout where the police are involved and someone died.

                                It's a guaranteed payday.
