What I find somewhat comical is the lack of concern for reality by the city... towns regularly dig up old burial sites from settlers/Indians/dead people buried in the past etc. and go about business with no disclosure. The sad reality is that if this guy's family fucks him over about the whole ordeal after he's gone, who's going to be able to point a finger? City govt's are known cretins, all they really have to do is pull up her headstone and be done with it. Collateral damage, if you will.

The compromise is that, should the property fall into ruin/disrepair/neglect, there is a Certificate of Deposit for $XXXX that accrues interest and will be used to inter her/his body should the property be seized in a legit manner by the city. Easy cheesy.

Eh, he requested a permit and was denied.... If they dig her up then that is a chance he took.

Outside of city limits do as you please. Inside city limits there needs to be rules.

Why? Private property is just that. Private. Don't like something? Don't look at it. Freedom. It's a wonderful thing

What about adding on a 15x15 room to your house?

I hate to tell you but not everyone lives in the country, with a rifle always in arms and your kid within arms reach every second of the day.

The one concession I will make is that a township obviously thrives off of it's citizens. Towns have laws and rules to live by, and those rules are to be followed since you live in that town's limits. Sure... you can own the property, but that doesn't mean that you can spit on city ordinances just because you own the land you live on.

Sounds like he's not. City allows family plots. That's exactly what he did. Now the city is saying "Oh wait....we forgot about that so....we're making you do what we say regardless."

"While the state can regulate cemeteries, Bradley said it doesn't have any control over family burial plots. The city contends the grave at Davis' home is an illegal cemetery that falls under government oversight, said Edmiston, the city lawyer." No control over family burial plots.

Why the hell not? Do like the Winchesters did and build 24 hours a day, 7 days a week for years and wind up with teh Wonka factory. As long as you're on your property, you aren't harming me.

Hell, if I had neighbors, I'm pretty sure they'd get upset about the stuff I do out here, but...... not their place to cross my drive gate.

Quite possibly an old law that was written when the city was quite small.

Why the hell did he apply for a cemetery permit if he was in the right?

That's just like my previous scenario with the additional room. If I apply for a permit to build onto my house, it gets denied, and then the city comes to tear it down I have no one to blame but myself.

Sure, that works great outside the city limits. Believe me, Im all for the city keeping their nose out of my buisness.

The thing you cant comprehend is that with a house 12' from the edge of my house is that I HAVE to see that bullshit. City ordinances are set up because of the close proximity houses and properties are within the city. If I want to sell my house, you can bet your ass that buyers wont want to live next to an overgrown jungle with bugs, snakes and rodents living in it. I dont want to live next door to that either. The value of a property is directly related to the surrouding properties, especially in a residential city area.

Did I put too many arruhs in it? The work laptop has a tendency to either stick on letters or not input them at all.
