    Not too sure about that one. Since I am a paying customer that is still waiting on his item, I don't see how he can legally remove me during business hours, especially if I am not causing a disturbance.

        Have you not paid attention in this thread? I can drive 60 miles up there and ask for it and I won't get it, then I have to drive 60 miles back home. If I lived 10 minutes away, sure that would be feasible.

            If they tell you to get bent, post the video on youtube. We will help distribute it.

              • I'd still file in small claims court and try something. You're letting him keep a grand of your cash and calling it even? Small claims court, hell find a lawyer friend and ask for advice on this, they can't just take your cash for a part and say frack off

                  I have researched this, it's a waste of time and money because I will not win. Even if I do, there is nothing in place to make him pay. If it were a car lot, I could file against his bond, but the great state of Texas doesn't make these fuckers carry any kind of bond or insurance of any kind.

                  I have pretty much checked every legal way and there isn't one in place for something like this. Any junkyard in Texas can get away with this so long as they have a no cash refund sign in place.

                      There is nothing to do a "no cash refund" with, since he NEVER gave you what you paid for! That's what everyone is trying to tell you. He sold you item # X and gave you item # Go Fuck Yourself. If it were a return/exchange, that's different and store credit whatever. But he hasn't given you anything except show you a jankity, stripped-down engine that you obviously didn't accept. Use Mustang Revival's idea, film it etc. and tell him you have all of the call records and he will be contacted by your Ambulance Chaser attorney that is paid only when he settles a claim... or he can give you the money/engine within 48 hours. That's your last options short of following him home and beating $1,000 worth of anger out of him.

                          But he is calling that junky engine he gave me the "first engine that I paid for" and since I "returned it", he is saying that he gave me an engine, but it wasn't good enough, so he is indefinitely trying to locate a new one for me.

                            Haha dude, there is. You may need a professional lawyer, but you are in your rights to your money still. A good lawyer would get it in about 30 minutes.

                              • Exactly. There's no refund, you never received anything. If he had handed you a blown engine then you'd be fucked but you never received anything, thus, it doesn't apply. Go talk to an attorney.
