Back in March 2011 my dog got out and scared a little girl. Completely my fault she got out. The girl got scared but she wasn't jumped on or my dog didn't get a hold of her. The parents or somebody called the city and then the circus began. They requested I turn my dog in so they can check for rabies, and see if she is aggressive. Two weeks later animal control deemed her dangerous, even after telling me she is the calmest/nicest dog in the kennel. They said they have evidence of a bite, and that's all they have to know. At that point I had three options: Let them kill her, pay the $450 to get her out of the kennel, and pay for all the dangerous dog crap (about $800 a year), lastly pay for all the crap to get her out and "appeal" it in court.
I choose the last option, because it's so fucking one sided. I found probably the best animal rights attorney in the area, and we filed for an "appeal" in JP court. THIS is where the crap really gets bad. The city ordinance goes against the state constitution. Something along the lines of no city ordinance/law cannot go against a state law. The city ordinance says you can only file in Municipal court, but state law says you can file in municipal, and JP court. Going to a city paid judge to possibly rule against the city is dumb as shit, and they don't know crap about animal law.
The city of Arlington doesn't know what to do once we filed since the city ordinance doesn't specify what actions for them to take. The city just left it alone denying my day in court (the city ordinance says I will get a court date within 10 days). Fast forward to today, the city has changed their law to be inline with state, but I still have to follow the old one. I now have to sue the city in district court to get them to act, and if they are smart they will settle out of court.
Cities write these crap laws that goes against the states, and just wait for people to force them to change it. They've probably killed 100s of dogs under the old law. Drives me nuts!
