  • Title Transfer Question

My mom passed away and left me her car. I've been to probate court and have all the documents naming me as executor of her will. I need to sell the car to pay some debts. I have a buyer but his credit union is insistent that the car be titled in my name before they will touch it. Can you get a new title same day at one of the Regional Service Centers?

well that sucks. So there's no advantage going to a regional service center over my local county tax assessor?

Yes you can get the title the same day from one of the reginal centers. There was a thread about it about 6 weeks ago thattalked about which ones are open now.

if it is in probate, you have to wait for the judge to sign off before you can sell it or transfer the title.

Only if the title is in your name first. To transfer it there is no faster way. Takes about two weeks to get it back now days.

I don't believe that's accurate. It's my responsibility to take possession of all property belonging to the deceased. The court doesn't ratify or approve my actions. This is Travis county - your county may be different.

BS, if your the executor for her Estate, you can sell the car... putting it in your name just to sell it is not necessary.

This is true. I didnt think about him being executor.

If the title is just missing and you have a copy of her DL and the executor paperwork, you can just go get one printed off on the spot.

You are correct according to the state of texas and the courts. Unfortunately my buyer's financial institution is insisting the car be titled in my name.

Wouldn't probate infer there wasn't a will for him to be an executor of?
