    Not to discount your injury, but if all your car has is a gouged bumper, you didn't do any physical damage to yourself, other than tensing up, and activating muscles you don't usually use. Take some midol and suck it up. If you have any sharp pain, it it persists for longar than a day or so, go get checked out, and have his insurance pay for it.

    This is exactly why drunks fair better in accidents usually, they stay relaxed.

      And it sounds like whiplash. It will suck tomorrow, and likely for a long time.

        This. When the illegal hit my truck on private property, I told the dispatcher to get here quick because it might get violent. Cops were there in 2 minutes.

          If you have a witness its his fault..

          Ive had the same situation happen to me back in the day..I got fucked though

          I was in the HOV lane 635 eastbound as soon as i got there from 35n.. well two cars in front of me almost get into a wreck and come to a complete stop. They both take off and im right behind them (this is between hillcrest and coit so you know how long ive been on the HOV lane) and as soon as i let off my brakes i get FUCKING PLOWED by a choctaw bingo bus. 2 guys bus driver and tour guide i guess?) immediately walk up to us and tell me its not smart to pull in front of a bus and slam on our brakes.. well the "entire" bus saw it and several went to the hospital.. Bunch of fucking liars trying to get money !!

          also when the police arrived they said we were shoving stuff under the seats and my dad went to the hospital so it was just my girlfriend and i (i was 17 at the moment) and the cops were very rude, treated us like criminals, spent an hour going through dads truck and didnt find anything. Officer Felini of the DPD can go fuck himself

                  Always have been told....if you hit anyone from behind. It is failure to control speed. Not saying that is right just seems to be the norm.

                          We went through this last May over on 114 & William D Tate. Two lanes turned right, we were in the left lane and in the middle of the turn, the other driver in the right lane decided he wanted to be in our lane and smacked into us. We waited for 2 hours for the police, it was a he said/he said case with only me (passenger) as a witness. In the end, both ins agencies investigated and we won. The police report was not a deciding factor as the officer could not officially say who went into who's lane etc.... Good Luck!

                            Am I missing something? You said you were already standing on your brakes before he even started using his, so why were you not able to stop first? Witness or not, this may not make sense to the investigators. Sadly, I think you'll be screwed. Good luck, though.

                            Last year, I got stuck at a light in the middle of 3 lanes, and needed to make a right turn about 1/2 mile or so after the light. I put my blinker on and when the light turned green, I sped up to scoot over into the right lane in front of some old lady. I was well-established in the right lane (with my blinker still on) before I went to make the turn, and the old lady rammed me good. Looking back, I admit that it may have been a little bit aggressive on my part, but not to the point of being dangerous (if she had been paying attention). I was in the F250, so it did much more damage to her Honda than to my truck. Anyway, at least two other cars stopped and told the cops that I cut the poor old lady off. Insurance still found her at fault.

                              And? Just because you hit someone from the rear doesn't mean that you're at fault. Most of the time, yes, but not if you're cut off. Say he's going 5 MPH faster than the other guy in the slow lane. He gets the front bumper of his car next to the rear bumper of the other guy when the car starts getting over. As he slams on his brakes to not hit the guy, the other driver also slams on his brakes to make his almost-missed turn. Not hard to imagine hitting someone in a situation like that. Even if the OP were speeding, it still wouldn't be his fault (unless he was hauling ass-there's the caveat for failure to maintain a safe speed). It's still your responsibility to yield to the car that is in the lane before you get over. The other driver ignored that responsibility as well as breaking a traffic law turning from the lane NEXT TO the turn lane.

                                I'm doing better today. Obviously I didn't explain this clear enough. Basically I was in the right lane and the other guy was in the middle lane. My front bumper was about even with the middle of his car when he basically made a quick turn into a parking lot (fron the center lane) so he wouldn't miss his turn. I was going about the speed limit.. it was a 40mph zone and I was in the 38-42 range. I saw him turning into my lane and slammed on the brakes so he wouldn't take off the front of my car and he slammed on his brakes to make the turn. Does that make sense? If he had maintained speed and simply changed lanes there would be no issue.. it was the fact that he turned into me while I was next to him and slammed on the brakes.

                                It was unavoidable and if I hadn't of reacted as quickly as I did my car would have smashed into the middle side of his... that probably would have been better since there would be no question of who was at fault. I should be alright based on what he admitted to and with the witness. I'm sure his story will change.
