LOL, umm no. If their is debris on the road and it causes damage to someone's vehicle, you are responsible for the damages. I'd like to hear you tell that to an insurance company who paid for the damages who is pursuing subrogation.

I am only going based on conversations I have had with agents and adjusters specifically regarding Texas.. Who knows, maybe I was given incorrect information. Where's GE when you need him?

That said, he did not see where the rock came from, and it was just sitting on the road. Who would the Insurance company subrogate with? And would they not consider it "avoidable" since it was already sitting there?

Doesn't matter.. It debris once it hits the ground. Truck is no longer responsible.

I don't think so. A truck had a blow out about an 1/8th mile ahead of me way back in the day and part of the tire was still in the road and I couldn't move away from it and hit it. I messed up my front bumper. The truck was pulled over and I pulled over behind it and got his insurance info and they paid for the damage. The trucker was bitching saying I shouldn't have been so close till I told him I was about an 1/8th mile back.
