I get that part, that was still 7 days after they left on their trip. Thus the phone would have had to have been sitting somewhere for 7 days on ready to be tracked without running out of battery.

If it was left at a store and wasn't there when the owner came back to claim it, then it was stolen.

Asurion will consider that lost, not stolen. It's more of a pain in the ass to consider it stolen anyways, you would need a police report before they'll even ship you another phone.
