      I think a stern talking to would be the better response than an arrest. Next time he'll wait until they climb into the yard and blast away.

        It's reckless. In the eyes of the law, you need to do everything in your power to avoid the situation. You only fire your weapon if you are in immediate danger.

        Look at it this way, you have three options:
        1. Avoid the situation.
        2. Further avoid the situation by showing your weapon.
        3. Fire your weapon because you or your family is in immediate danger.

          Also, showing your weapon is not legal unless you are deterring a harmful situation. Your weapon can be seized if you show your weapon in a public setting. A backyard is considered public.

          In any case, as soon as you pull your weapon the police deserve a phone call. He didn't call, he pulled a weapon, AND he discharged said weapon. Police officers do not take kindly to a person who fires a weapon publicly and fails to report it.

              That is just an assumption I made. I do not know what the law states. I assume so though considering you are really only protected when an intruder is inside your home. Look at all the homicide cases involving an intruder being shot on someone's front lawn, if it isn't inside your home you really should not discharge your weapon.

                When did he have time to call? It says he ran around front and was greeted by police. I don't usually keep my cell in my underwear while I'm sleeping.

                    I can't click on the link, but think I saw this last night on the news. Was this the one where no one got into his fence or yard, and were supposedly "shaking his fence" "trying to get in". I never have understood warning shots. If you walk outside and say "get the F out of here", I am sure that will have the same effect. I'd rather keep my bullet if he gets in that fence.

                              I understand the whole wreck less part but it sounded like he shot in the ground to be as safe as possible. I don't see how pulling your gun in a dark backyard is going to scare someone.
