    I thought Texas was right to work state...cant you just can him because he sucks? do you have to have a paper trail?

          Not necessarily. The former employer can contest the claim. Then both parties call in on a certain day and have a conference call with the person from TWC. Each party makes their claim and the TWC agent makes a decision whether to give the unemployment pay or not. At least as far as I knwo this is still how it works. I went through this with a former employer that canned me for fictional reasons. Since he was making up a reason he had no proof of anything so I got my unemployment pay.

          However, with a good paper trail showing that the employer gave warnings, whether verbal or written, will almost always end up in the employer to having to pay. At the club we had another sound guy that I hired, he was a good soundguy but a completely arrogant dick to a lot of the acts. I would constantly get calls to come run sound on his nights because the band didn't want to work with him. We asked those acts to send us an email with all the info on instances and such. We finally got rid of the guy and he filed for unemployment. I, along with the managemrnt of the club gave statements of the instances and we also submitted copies of the emails we were sent. TWC denied his claim.

            The very best part of not being in management anymore is not having to deal with 30 employees. Every single day brought a new crisis and 95% of it was caused by my employees.

              This is a right to work state... you have the right to leave anytime you want... you just don't have the right to return. So, you can either do your job right or start exercising your right to put the left foot in front of the other. Your choice!

                I have a good method for getting rid of ppl.... I pull them to the side, away from others, and when they're not expecting it so I can speak freely and not be afraid of being recorded...

                Then I tell them how it is... and I say something along the lines of:

                "It's obvious that you aren't happy working here, and its obvious that I'M not happy with you working here... so how about this: You turn in your written two week resignation RIGHT NOW, and I'll let you work those two weeks, I'll work with you if u need off early for an interview, I'll even give you a good reference if you want to use me as one!!

                OR

                You can choose not to take me up on my offer, and I will fire you when you least expect it... and its usually right around a holiday... your choice, but I need to know NOW."

                That way, when they turn in their 2 week notice, they can't get unemployment.

                Haven't had one turn down my offer yet!

                  Yes. If management has documentation of policies violation including incompetence or inability to perform the job. The employee will lose unemployment benefits.
