This. Seems like a complete bone-head move to me. Why sacrifice the use of your own property to appease this old hag?
Well I did it for a couple reasons.
1. the city of mesquite has a 3 foot easement at the property lines. The fence was a common fence so it was right in the middles of that easement. So realistically I lost maybe around a foot if that.
2. i did it because I would not have been allowed into her backyard and when we went in to hang the pickets she would have just called the cops for me trespassing.
3. I extended my fence forward from its original position and with her fence still in place we had to move it in a little to be able to put the pickets up and for me to stain it later on.
I was originally going to put it back in the same spot and then make a inside cut and then extend it at the front. She told me that she did not want a common fence any more so I will have to move in some and so will she so we will both be able to get to our fences for staining or repairs exc.
4. She wanted it done quickly so her backyard would not be exposed so with the fence done this way it is on her dime now and she will have to put a fence up. You could think of it as a tiny up yours.

I would've put it on the line and told her to call the cops for trespassing. She told you she didn't want a common fence so the only way to put it back is to step in her yard by 6 inches. I doubt a cop would come out and arrest you for stepping 6 inches in her property to put up a fence that is on each of your property line.

This probably doesnt hold much legal water, BUT the first item on her letter to him pretty much states she does NOT want the common fence or any part of his fence on her property or touching her new fence and she would be replacing her side on her own. Granted that doesnt mean shit to the nut-bag, but there is some sort of agreement already in writing...
It would be hilarious if she had her contractor build her new fence and it somehow encroached on his property and she had to tear it down and move it back, LOL.
Now you could go on that route. Hope she builds it on his side because of the location of his fence and forces her to tear it down
These are both correct. I know where the easement line is and I know where the stated property line is so if her fence goes over it then I will get a little revenge.

this is true but it is also a chance. Maybe not going to jail but maybe tickets and then give her more ammunition to when she does call the cops on me for noise she can pull out the trespassing violations against me. I didnt feel like tempting the law.

Fence looks good and yes as soon as she try's to build her fence up against yours let the fence company lay the posts in concrete then call in on them trespassing and destroying your property. They will have to tear them out and will charge her if she told them to build it that way.

Tell her to suck a dick. You cannot change a fence that runs along two properties without being on their property, unless you move it back which to me, is unacceptable. That is your property, you paid for it, it is yours. What are you going to do if you move, some poor bastard will be stuck with it now.
This is anger towards her, not necessarily to you.

I prefer to play a more sophisticated mind fuck. Remind me to tell how I managed to get rid of a nightmare renter over a $50 unauthorized service call and wound up with a lien (on the house she bought when she moved out) for damn near the maximum judgement allowed in Texas small claims court.
