You could tack on a $100 tip for a $20 meal, that doesn't mean that it's required by law to be paid though, gratuity is optional. Even if it's listed in fine print, I still don't know that there's any recourse, other than a civil suit.

Taking hostages certainly isn't the way to go.

Not really. You have the right to detain someone if they are committing a crime. Of course you open yourself up to potential litigation if you do, but anyone can sue for any reason whatsoever any way. Snatch a pizza out of a delivery guys hands and slam your door in his face without paying, and the next knock at your front door will be Matt looking to take his anger out on someone after logging off here.

By that logic, paying the whole bill is optional. When they say they are adding 17% gratuity, that means they are increasing the listed price by 17%. A $20 meal is now $23.40.

Gratuity, when added by the restaurant, is NOT optional. That's the whole purpose of people adding 15-18% on parties of 8 or more (some restaurants do 6 or more).

It wasn't optional in this case because of the size of the party. It was clearly stated. They could have left without ordering and gone elsewhere. It's just more bullshit entitlement coming from pricks that are upset about not getting their way.

I'm fine with that, but if it wasn't stated anywhere, like Brent said can happen (I dunno of it was here or not), they would have no idea that they were going to be charged until recieving the bill. In a case like that,I don't see there being even civil ground to stand on, as they werent given the option to go elsewhere.

If it was stated, then yes, pay up and move on. I don't think what the family did was right, but I also don't agree with locking them in the restaraunt.

Watch the vid if you can, they show the menu where is shows it in bright red lettering on a white background that gratuity would be added. So I agree with Eric and Brent it's straight up theft.

I bet something like this happened when they started scanning through the menu:

Customer 1: Oh dang, look at this, it says you gotta pay 17% for 5 or more people.
Customer 2: Dang gurr, we got 5 or more people.
Customer 3 (The person paying): Shooot, I ain't payin' no 17% graturry, watch...

IMHO, 17% is not unfair. I dislike mandatory tips that are higher - because I like to determine if someone gets 10, 15, 20 or 25% - but I'm quite okay with just 17%. If there is an issue, it can be handled otherwise.

There were also signs plastered all over the front of the place stating the policy. I would have locked their asses in the walk in freezer and turned the lights out until the cops showed.
