I don't think it matters how much percentage someone owns, if they own it together they both need to agree to sell it. If she makes his life he'll if he moves in there, he should return the favor.

A friend of mine owns 85% of his house and his mom owns 15%. The house was gifted to him from his grandpa but his mom was given 15% of the house so that she would forgive his dads backed child support. He wants to sell it because she wont let him live there(strange situation).
Since he owns the majority can he sell it without her permission?

If she is a complete bitch he is fucked.....I went through a 4 year probate with my step mother when my dad and grandmother both past. I own 75% of the house, my sister has 25% and my step mother NONE, but she still gets to live in the house rent free. We CANT live there and can only do one walk through a year with a 30 day notice in writing. She does have to pay the taxes, but i have to pay the insurance. Nothing I can do about it unless she dies or moves out with intent not to return. The only way to prove intent would be for her to homestead another property. So basicly she could live somewhere else, and only stay there one day a month and i couldn't do shit about it. Trust me that the laws on this are not quite as clear as some might think.
