  • Can someone sell their house if they own 85% of it?

    A friend of mine owns 85% of his house and his mom owns 15%. The house was gifted to him from his grandpa but his mom was given 15% of the house so that she would forgive his dads backed child support. He wants to sell it because she wont let him live there(strange situation).
    Since he owns the majority can he sell it without her permission?

      If he had the money he would. I dont think she would leave unless he offered her an insane amount of money for a $60-70K house.

            it would only make sense that he would just have to give her 15% of the sale price

            but it does depend on the person named on the title

                Whoever is on the title is who has to sign and "approve" the sale. If it's just him then he can sell it, but if the gift was done legally and recorded then he could end up just paying her 15% of the proceeds, but she couldn't stop the sale if it is titled in his name only.

                You can bet it's in both their names.

                  Houses don't have titles like cars. If it's in his will with an 85/15 split they will both be required to sign.

                    if both names are on the title then its basically considered a 50/50 split...

                    unless there is something in writing(his will) or there is a voice recording of him saying that

                      You could negotiate with the other party and have the title company write you both a check at closing, assuming both parties are willing.

                        It was done legally with lawyers present and the grandpa already signed it over so there's no will. His mom just freeloads in the house and makes his life hell if he tries to live there. Im pretty sure the deed is in both of there names and it states that he is the majority owner.

                          He can sell his 85% interest but I doubt anyone would want to live with his mom and her anchor 15%.
