    Its devils advocate stuff, sensitive sally. If you, yourself, are placing the major part of the blame on the seatbelt then you logically can relieve yourself of the major part of the blame. Also relieving the major part of the guilt. This is only if you are actually placing the majority of the responsibility on the mans failure to wear the seatbelt.
    I have had experience with the same type of incidents, and close friends and family involved in worse, one involving serious jail time. I know about the difficulties accrued when you unintentionally harm someone, welcome to life. What law should we pass to prevent your uncle's anguish? What should our government do about that?
    Nothing, obviously, since stupidity was the reason it played out the way it did. However, his situation has no bearing on a seat belt violation: I was merely backing up my opinion with real life situations involving someone else's unintentional auto-related death not being as benign as you're making it out to be.

    As for real legislation: sign a bill into law that terminates the civil liability of a driver if the death of another driver occurred while they weren't wearing a seatbelt.

          You are right, it is definitely not easily dismiss-able, it was not my intention to say that it was.
          That one would be tough. Too many varying degrees of grey between the responsibility of the driver to protect himself and his right to drive without anothers actions irresponsibly causing him harm.

              i love how in my 6k lb truck the govt says i have to wear a seatbelt, but all i have to do is send in a copy of my insurance and title for my motorcycle and that same govt. will send me a sticker that allows me to not wear a helmet while riding.

                    Texas seat belt law does provide for a few exceptions for front seat passengers, such as for US Postal Service employees, newspaper delivery people and utility meter readers who have to get in and out of the car all the time as part of their job duties. Also, if you have a medical condition that makes it hazardous for you to have a seatbelt on, you can get a doctor's excuse for it. Additionally, seat belts are not required on small farm vehicles such as tractors that weigh less than 48,000 pounds.
