It's not like you get stopped by mr leo and ask you been drinking, and you say no, even though he can still smell it, says I think you have and we need to do this. You refuse and he let's you go.

It's different - this weekend, you can not refuse the blood draw if you refuse the breath test / field sobriety stuff.

That's SOP for most local departments. 24/7/365, not just holiday weekends. I know someone that got a DWI on Tues, and was hauled in to the hospital for a blood draw prior to being taken to jail.
