              Incorrect, Texas does have common law marriages - it's defined as one man & one woman presenting themselves as married - which consists of them cohabitating & having comingled assets (joint bank account).

              In fact, after soemone has been in your house for 48 hours - they have residency rights.

                  Three elements must be present to form a common law marriage in Texas.

                  First, you must have "agreed to be married."

                  Second, you must have "held yourselves out" as husband and wife. You must have represented to others that you were married to each other. As an example of this, you may have introduced you partner socially as "my husband," or you may have filed a joint income tax return.

                  Third, you must have lived together in this state as husband and wife.

                  a joint bank account does not on it's own constitute commingled assets for the purpose of common law marriage. Two individuals can have a joint account. My girlfriend and I do, it's what I pay the bills out of, we both transfer money into it from our individual accounts. On the account we are listed as joint account holders not married.
