Three elements must be present to form a common law marriage in Texas.

Third, you must have lived together in this state as husband and wife.
a joint bank account does not on it's own constitute commingled assets for the purpose of common law marriage. Two individuals can have a joint account. My girlfriend and I do, it's what I pay the bills out of, we both transfer money into it from our individual accounts. On the account we are listed as joint account holders not married.
