      His property will be returned as soon as investigation is done with.... Same thing occurs when a police officer is involved in a shooting, his weapon is taken away and held as evidence until the investigation is over with. It is returned to the officer if he is cleared by the DA at that point.... He'll get his weapon back for sure... Just going to tak a little time. My .02

            Why do police collect it? It's evidence.

                    Matt, will you thin that out for me? I got lost about half way through all of the links. Where does it say how long it takes to return a citizen's property and if a citizen is victimized because the police have his property, does the citizen who has not been charged with a crime yet had his weapon seized, have legal recourse against the police department for making him vulnerable?

                        I didnt read any of that, but I think what he is saying is that it is the court system that clogs up the process of getting your stuff back, not the police dept. Which is very easy for me to believe, knowing how screwed up and back logged the Dallas court system is.

                          Right, but instead of working to quickly return your property or handing it back to you as soon as is legally possible, they make you come to them and it's your responsibility to stay on top of things asking for your weapon back, if they will even take your call on it. That's the police's responsibility. And with them taking your protection away, is there any legal recourse for injuries caused by them taking away your ability to protect yourself?

                            You can hire an attorney and sue in civil court, but that's probably it. No doubt it's a fucked up process.

                            What I was saying is, the police can not return the property until the courts tell them they can.
