Shooter Who Stopped Robbery Wants Gun Back

    I know a guy that went through a TSA with a weapon going on 3 years ago. Long story short, he was not charged with anything (CHL holder, no record, and was cooperative...etc), but just a fine from the TSA. He spent the night in jail and was released.

    Anyway, even though no charges were filed - he still is not able to get his gun back. He was told it's being held for 3 years. Then he has to pay for some paperwork and such and then get his gun back.

    Now, this guy is not unhappy or complaining. He was treated fairly considering what he did. However, he was not charged and is having to wait for his gun back. That's the point. If your gun goes to the police, may as well write it off for a few years at best.

      It's always the police's fault.

      People need to get a grip on responsibility.

      If the case is filed, the evidence is under the constraint of the court. It's not like the police want to keep another gun, knife, or any other item. Stuff like that sits around for years. If there is a chance to dispose of something, trust me, we want it gone.

        The involved officer is usually issued another gun. The case may take years to get make final disposal.

            Kinda hard to fault the cops on this one. Yea, this man should get his gun back but there are so many legal strings the police have to maneuver through in things like this that I can understand their desire to hold onto the weapon in question...

            I think this is more of a problem with the system the police work in than the police (or prosecutor) themselves.

            I remember that old Junk yard owner that shot two burglars within a few weeks of each other. The police took his shotgun as evidence and he had to go out each time and buy a new shotgun. I recall Fox 4 ambushed him while he was in the process of buying the 2nd new shotgun..

                Concur, but once it is confiscated - it's gone for awhile at best. Regardless of charges being filed, not guilty and so forth.

                        If the police confiscate my gun and never give it back (theft) and its not the police's fault, then who's fault is it ?

                          If it's not the fault of the people taking your weapon from you whose is it? If I walk up and take your weapon from you or take your car, is it not my fault for doing it? If I ask you to hand me something of yours, do I not have an obligation to return it? Why is the citizen penalized when they have done nothing wrong?

                          It does sound like people need to get a grip on responsibility. And those people would be wearing blue with a badge and gun

                            I remember that and it happened in West Dallas off of Chalk Hill Rd, my cousin lives across the street from that place. Felt really bad for the old man and how the media treated him. I forgot how many times he had been robbed and he had enough. It's fucked up how that one reported ambushed him outside of some sporting goods store buying another gun because the police had confiscated his during the investigation. Think it was Becky Oliver? I think I got the video saved at home, bitch made that old man cry to.
