Yep. But they still take the one used in the incident.

No they don't. Ask to see it.

So were things equal, they'd take the offending weapon and hand the citizen another until his is returned.

Shouldn't be an issue. If it's justified, why take it?

IF they decide it's evidence, it's theirs AT LEAST until the case is over. If there's a good chance that guy appeals, then he's just fucked. He'll never get it back.

They wouldn't hand me another one. I would have to use one of my other guns. Although I am on a smaller department and we buy our own guns.

True, where I was they issue 2 handguns a shotgun and a rifle.

So they send you out to do your job unarmed?

^ This. Also I don't know one officer that only has one gun. I have never been in a shooting. I couldn't have started working where I am at unless I had bought a gun ( already had several) and qualify with it. I have 2 identical guns. So it would be easy for me after I was taken off of desk duty.

Sadly this is pretty standard, my neighbor who is a LEO said if you have to shoot someone try to do it with a gun you don't mind not getting back, there is a good chance you never will. One of the lovely things about this country.

And when he is cleared of any wrong-doing, he gets it back, right?

that totally blows...I was hoping to scratch a mark on the stock each time I capped some one.

Would it be illegal to damage the gun beyond repair after a shooting so that no one else could enjoy a free gun?
