My brother recently won custody of his son during the divorce. The judge awarded a whopping $23 a week in child support from his ex wife. She makes approximatley $30-34k a year and pays a tall $1000 annually. You can not even feed a puppy on $100 a month.

Had the table been turned he would have been hit for around 8-10 times that a month and makes roughly the same a year.

That might be what your ex agreed to, but that is not the standard procedure.

A close friend of mine is going through shit trying to get child support stopped. Apparently from what his attorney said, Texas purposely makes it tough to stop child support once the child gets old enough (18) because statistically after the child support stops, the mother and child usually file for some form of state assistance.

After a modification some years ago, my papers were adjusted, by the AG's office, to stop when my boy turned 18. Contrary to what the original divorce decree states, which was when he turned 18 or after he graduated whichever came last, it actually stopped on the correct paycheck. Amazing.

Then they use that money on themselves and not for the kid or kids.

We negotiate who claims what based on how it affects our taxes. We actually run numbers with both kids and one kid each. Then, we compare numbers, see who benefits the most, and come to an agreement on a settlement. We each claimed one one year, he claimed both the last two years, and we're each claiming one this year. I should be claiming both, but the deduction is worth more on his return, so he's paying me the deficit and keeping the remainder. Everybody wins.

However, I do not agree with some states having "spousal support" ( or whatever it is called) or the fact that you might have to split some of your retirement benefits and so forth. etc.

The benefits of being married to someone who has money or works hard should end at the divorce. Why should the woman or the man benefit from the other once they chose to end the relationship? Split your material possesions and debt 50/50 and move on with life. Don't put both of your names on a car title and whoevers name is on the title gets the car and car payment... etc. People should not benefit financially from the other person after a divorce.

That's the funny thing about a community property state. The equity in the house, cars, and investments that were acquired during the marriage are equally divisible.

In Texas, spousal support is hard to come by. You have to be able to prove that you are generally limited from making a decent income because your relativity in the job market was affected by the marriage, i.e., You've been a homemaker for many years, at the request of your spouse, without suitable work history to find a job that will support the standard of living you enjoyed while married to your executive husband, your divorce settlement won't provide for your basic needs, or the spouse is mentally/physically incapable of gainful employment, or is taking care of a disabled child, and you were married for 10+ years. Also, if one spouse was convicted of family violence within a specified time frame prior to the divorce, the other is automatically entitled to spousal support.

I am soooooo glad I never had kids with my ex wife. She was bat shit crazy and I would be one of them guys that was in court every year. I heard the stories even when I was growing up about crazy child support issues and lunatic ex wifes and said screw it I am not interested. Got remarried a few years ago and she had no kids either. Went down and got cut a couple of years ago and do not regret it. I can honestly see where the courts and an ex wife would drive people do to some crazy shit. You screw with peoples money like it is some kind of joke or payback and that shit gets out of hand fast.
