  • Legal question, need some help here!

    So, yesterday I gave my two weeks notice at work. I said I would work through the end of the month, give 100%, and be done on Saturday the 28th.

    Today, they ask why I want to stay till the end of the month and if I had anything still in progress. Other than a client I have today, nothing else going as of right now. I am in a full commission position, no salary, and they are out of office space so they asked me to finish out today and go since they have a new employee that has not had a desk since he started a few weeks ago.

    Since I am only commission, and I gave them two weeks notice but they are asking me to leave early, am I entitled to some form of pay for my two weeks that I am missing out on potential income? The way vacation is paid is an hourly rate based on the prior quarters earnings. Would they be legally requried to pay me that? Minimum wage for my hours?

    Need an answer quick if you got it!

      They don't owe you shit. Two weeks notice is a courtesy of the employee. They are not obligated to let you work that two weeks. Commission or salary makes no difference.

        You might be able to get some payment for your unused vacation days, depending on the company, but that's about it.

              I would bet that since he gave his notice to leave that if the deals are not done, completed, billed, invoiced, etc, they will likely not pay him commission for them.

                That's actually what a lot of companies do though, let you go immediately once you've expressed your intent to leave the company. They don't want you hanging around collecting information to use against them with a competitor or possibly screwing up relations with their customers, vendors, etc, etc. You should have posted before you gave your notice so that you would have all this information ahead of time.

                  Depends on the company and their policies in regards to invoicing, terms, etc. everyone is different.

                        Thanks, I was not expecting anything, but I have heard of "Pay in leiu of Notice" which is usually what happens with most salary positions (i know they do that here for sure) but even HR was unsure about it because of the commission based position and never having run into this before. She is finding out for sure. Either way, I have no other pending deals, everything is wrapped up and I am getting paid for what is already done. I'm fine with it as is since I already basically checked out, again, just more curious than anything else regarding the legal side of it.

                            usually here they are fired lol, or they are too stu-stu-stupid to ask about something like that. I think she was more taken by the fact that I had some sense and asked about it.

                              Yeah, seems like you've positioned yourself to leave at a good time. Terrible to try and get commission pay if the employer does not pay it - after you've left.
